Terms and Conditions

1. Scope:
   1. These General Terms and Conditions (GTC) apply to all services, offers, and contracts concluded between Michaela Baumgartner, B.A., certified Mental Trainer, Mind-Plant e.U. (hereinafter referred to as the "Provider") and her clients. Deviating terms and conditions from clients shall not be recognized unless the Provider expressly agrees to them.
2. Subject of the Contract:
   1. Die Anbieterin bietet Mentaltraining in verschiedenen Formaten an: Einzelmentaltraining in der Natur oder Online, Seminare für Privatpersonen, Seminare für Unternehmen, Workshops, Retreats, Projekte, etc. Die genauen Inhalte und Termine der Leistungen werden im jeweiligen Angebot oder Vertrag festgelegt.
3. Teilnahmevoraussetzungen:
   1. Participation in the Provider’s services requires normal mental and physical resilience. If the client is unable to attend the nature location for health reasons, an online alternative can be arranged.
   2. Participation is at the client’s own responsibility. Clients are obligated to inform the Provider in advance about any health restrictions or risks.
4. Terms of Execution and Cancellation Policy for Seminars at Seminar Hotels:
   1. One-day and two-day seminars for private individuals at the listed seminar hotels will only take place under the following conditions:
   2. Minimum number of participants: 3 persons, however with an additional cost surcharge.
   3. If there are 3 to 4 participants, an additional cost surcharge must be charged to cover room rental and other expenses. Minimum number of participants without additional surcharge: 5 persons.
      No additional surcharge will be charged for groups of 5 or more participants.
   4. Maximum number of participants: 12 persons.
   5. If fewer than 3 participants register by 2 months before the seminar date, the seminar will be canceled. No cancellation fees will be charged to the participants.
   6. If the participant books a room independently and the seminar is canceled, any cancellation fees for the accommodation must be borne by the participant.
5. Terms of Execution and Cancellation Policy for Workshops, Retreats, Projects, etc.:
   1. Die Mindestteilnehmerzahl wird von der Anbieterin jeweils individuell und angepasst an das jeweilige Event festgelegt. Wird diese nicht erreicht, werden bereits angemeldete Teilnehmer rechtzeitig informiert und es wird ein Ersatztermin angeboten. Bis 14 Tage vor dem Event: kostenfreie Stornierung
      Up to 7 days before the event: 50% of the invoice amount is charged.
      Up to 3 days before the event: 70% of the invoice amount is charged.
      1–3 days before the event or in case of no-show: 100% of the invoice amount is charged.
6. Stornierung und Rücktritt bei Einzelmentaltraining:
   1. Booked sessions for one-on-one mental training can be canceled free of charge up to 14 days before the scheduled date.
   2. Cancellations made within 14 days before the appointment will incur a fee of 50% of the agreed fee. Cancellations less than 48 hours before the appointment will be charged the full fee.
   3. If the Provider must cancel an appointment for important reasons (e.g., illness or force majeure), an alternative date will be offered. No claims or compensation for resulting expenses shall be made.
7. Stornierung von Seminaren in Unternehmen:
   1. For cancellations within 2 months before the seminar/lecture start date, the following applies:
   2. 10% of the seminar fee will be charged.
   3. The cancellation fee 1 to 2 months before the seminar/lecture start date is 25% of the costs.
   4. From one month before the seminar start date, 80% of the seminar fees are due.
   5. For cancellations made one week or less before the event, the full amount will be charged.
8. Besondere Bedingungen für Seminare in Unternehmen und Vorträge:
   1. The order can be placed either in writing or verbally.
   2. Der Rechnungsbetrag ist innerhalb von 30 Tagen nach Erhalt der Rechnung ohne Abzüge oder Spesen zu zahlen.
   3. In case of late payment, default interest of 10% per annum will be charged.
   4. The content and scope of the services are defined by the respective service description of the Provider.
   5. All prices are exempt from VAT according to § 6 para. 1 no. 27 of the Austrian VAT Act (Small Business Regulation).
9. Leistungen und Zahlungsbedingungen für Privatpersonen:

   3. Payment is made by direct bank transfer and must be completed before the start of the service. When booking via the website, payment is made through the Stripe payment link. The invoice will be sent by email afterward.
   4. By paying the invoice, the client confirms their participation as well as their acknowledgement and acceptance of the Terms and Conditions and the liability provisions.
10. Haftung:
    1. The Provider is only liable for damages caused by gross negligence or intent.
    2. No liability is assumed for damages resulting from improper application of the taught techniques.
11. Datenschutz:
    1. By paying the invoice, the participant agrees that their personal data will be stored in compliance with the GDPR and that emails and WhatsApp messages may be sent.
    2. The Provider processes personal data only in accordance with legal regulations.
    3. Further information can be found in the Provider’s privacy policy.
12. Terminbuchung: 
    1. On the website mindplant.at The service provided by Brevo is used for appointment booking. Brevo Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany. Brevo is a SaaS solution for relationship marketing that enables efficient management of appointment bookings. Personal data, such as your email address and possibly other contact details, are stored on the servers of Sendinblue GmbH in Germany. A data processing agreement (DPA) according to Article 28 GDPR has been concluded with Brevo to ensure that your data is processed in compliance with data protection regulations. 13. Changes to the Program or Cancellation:
    1. Program changes, changes to event dates, locations, times, or trainers are reserved. Customers will be informed of changes as soon as possible. If an event cannot take place due to the trainer’s illness or unforeseen circumstances, there is no entitlement to execution or compensation. Replacement dates will be offered.
14. Disclaimer:
    1. The Provider assumes no liability for personal belongings of participants or for damages resulting from improper use of the provided content. Clients act at their own risk and confirm upon registration that they have sufficient insurance coverage. Any damages or injuries occurring during the events are excluded from liability.
    2. Participation in the events is at your own risk and responsibility. This applies especially to all activities involving physical demands or increased risk — such as climbing or moving in difficult terrain.
       The participant commits to taking part only in a medically suitable condition and to strictly follow the instructions of the event organizers as well as any external professionals. It is the participant’s responsibility to ensure adequate insurance coverage (e.g., accident and liability insurance).
15. Foto-, Video- und Audioaufnahmen:
    1. Bei Veranstaltungen können Foto-, Video- und Audioaufnahmen gemacht werden. Mit der Buchung erklärt sich der Kunde einverstanden, dass diese Aufnahmen für Werbezwecke (z. B. auf der Website, Social Media, Flyern, Roll-ups) genutzt werden dürfen. Die Rechte an den Aufnahmen verbleiben bei der Anbieterin.
16. Höhere Gewalt:
    1. Kann eine Veranstaltung aufgrund höherer Gewalt (z. B. Naturkatastrophen, Terroranschläge, Pandemien, etc.) nicht stattfinden, ist die Anbieterin nicht verpflichtet, diese durchzuführen. Eine Haftung für daraus resultierende Kosten (z. B. Reise- oder Übernachtungskosten) wird ausgeschlossen.
17. Schlussbestimmungen:
    1. Es gilt das Recht der Republik Österreich.
    2. Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleiben die übrigen Bestimmungen davon unberührt.
    3. Gerichtsstand ist der Sitz der Anbieterin.

Ich, Michaela Baumgartner, B.A., Dipl. Mentaltrainerin, biete ausschließlich Leistungen im Bereich des Mentaltrainings an. Meine Tätigkeit umfasst die Unterstützung von Menschen dabei, eine Standortbestimmung ihres aktuellen Lebens zu machen und Werkzeuge sowie Methoden zu erlernen, um zukünftig besser mit Herausforderungen umgehen zu können.

Ich bin kein Arzt, Psychologe, Sozial- oder Lebensberater und führe weder Diagnosen noch Therapien durch. Meine Arbeit bezieht sich ausschließlich auf die Zukunftsorientierung und beschäftigt sich nicht mit der Bearbeitung von Vergangenheitsereignissen oder traumatischen Erlebnissen.

Ich weise ausdrücklich darauf hin, dass meine Angebote keine psychotherapeutische Behandlung oder ärztliche Beratung ersetzen und bei ernsthaften psychischen oder physischen Problemen ein Facharzt oder Psychologe aufgesucht werden sollte. Die Teilnahme an meinen Angeboten erfolgt auf eigene Verantwortung. Eine Haftung für mögliche gesundheitliche, psychische oder andere Schäden wird ausgeschlossen.

Der Teilnehmer erklärt sich ausdrücklich damit einverstanden, dass die angebotenen Mentaltrainings, Maßnahmen zur Persönlichkeitsentwicklung beinhalten können. Außerdem erkennt er an, dass mögliche emotionale Erfahrungen, Teil des Mentaltrainingsprozesse sind.

Die Privatsphäre ist wichtig – deshalb bleiben alle persönlichen Informationen und Erfahrungen des Mentaltrainings vertraulich.

Mit Zahlung der Rechnung akzeptiert und bestätigt der/die Kunde/in die AGB sowie die Haftungserklärung.
